1. About these terms

These Terms of Service ("Terms") govern your access to and use of the ProperWater website and your purchase of products from us. In these Terms, "we", "us" and "our" refer to ProperWater Pty Ltd (ABN 33 698 276 738, ACN 698 276 738), and "you" refers to the person accessing our website or placing an order.

By using our website or placing an order, you agree to these Terms. If you don't agree, please don't use our website.

2. Eligibility

To purchase from us, you must be at least 18 years old and able to enter into a legally binding contract. By placing an order, you confirm that you meet these requirements.

3. Products and availability

We sell water filtration products and related media. We make every effort to display our products and their specifications accurately, but we don't guarantee that descriptions, images or other content are complete or error-free. Product availability may change without notice, and we reserve the right to limit quantities or discontinue any product.

Our products are compatible replacements designed to fit certain third-party filtration systems. Where we refer to other brands (including Complete Home Filtration / CHF), we do so only to indicate compatibility. We are independent and not affiliated with, endorsed by, or sponsored by those brands.

4. Pricing and payment

All prices are listed in Australian Dollars (AUD) and include GST where applicable. We may change prices at any time, but changes won't affect orders we've already accepted.

We make every effort to ensure pricing is accurate. If we discover a pricing error on an item you've ordered, we'll contact you to confirm whether you wish to proceed at the correct price or cancel the order. Payment is processed securely through our third-party payment providers at checkout.

5. Orders and acceptance

When you place an order, you're making an offer to purchase. Your order is only accepted once we send you a confirmation of dispatch — not when you receive the order confirmation email or when payment is taken. Until then, we may decline or cancel an order for reasons including product unavailability, a pricing or description error, suspected fraud, or inability to deliver to your address. If we cancel an order you've paid for, we'll refund you in full.

6. Shipping and delivery

We ship within Australia in accordance with our Shipping Policy. Delivery timeframes are estimates only and are not guaranteed, as delivery is carried out by third-party carriers. Risk in the products passes to you on delivery.

7. Returns, refunds and consumer guarantees

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Returns and refunds are handled in accordance with our Refund Policy, which forms part of these Terms. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law.

8. Installation and use of products

Our replacement filters and media are intended for use with compatible filtration housings. You are responsible for confirming compatibility with your system, and for fitting and maintaining products in accordance with the instructions provided. We are not responsible for damage or loss arising from incorrect fitting, unsuitable use, or use with incompatible equipment.

Where we arrange whole-home filtration installation services (Perth metro area), those services are carried out by independent licensed plumbing partners, and any installation work is subject to separate arrangements and the relevant licensing and warranty conditions.

9. Our liability

Nothing in these Terms limits your rights under the Australian Consumer Law. Subject to those rights, and to the extent permitted by law:

• our products and website are provided without warranties beyond those required by law;
• we are not liable for any indirect, incidental or consequential loss arising from your use of our website or products; and
• where our liability cannot be excluded but can be limited, our liability is limited to (at our option) replacing the product, resupplying it, or refunding the price you paid.

10. Intellectual property

All content on this website — including text, logos, graphics and product descriptions — is owned by us or our licensors and is protected by law. You may not copy, reproduce or use our content for commercial purposes without our written permission.

11. Acceptable use

You agree not to use our website for any unlawful purpose, to interfere with its operation or security, or to attempt to gain unauthorised access to any part of it.

12. Third-party links and services

Our website may contain links to third-party websites or rely on third-party services (such as payment providers and our e-commerce platform). We're not responsible for the content, policies or practices of third parties.

13. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms.

We may update these Terms from time to time. The version published on this page at the time you place an order applies to that order. We encourage you to review these Terms periodically.

15. Governing law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia.
